Ahead of the London Pre-Moot (https://londonpremoot.uk/), an international arbitration competition, Professor Thibierge took part in the traditional inaugural conference held at Jones Day’s London offices.
Alongside London Pre-Moot head Peter Ashford, LCIA Registrar Eliana Tornese, and Jones Day partner Michelle Bradfield, Professor Thibierge discussed the complexities of this year’s moot problem.
He addressed the merits of the case, focusing in particular on whether the Respondent could validly invoke force majeure or rely on Article 79 (impediment) of the CISG.
He adopted a comparative perspective, examining the issue through both Common Law and Civil Law lenses.
Professor Thibierge later served as a coach for Aix-Marseille University at the London Pre-Moot, held at the London International Dispute Resolution Centre.
